The growing trend of civil sanctions in regulatory law

When the safety sentencing guidelines came into force, many were concerned about that it could lead to dramatic increases in safety sentencing. They did. But while all eyes have been on the sometimes eye watering fines grabbing the headlines, in parallel we have seen more and more areas adopting civil sanctions a regulatory penalty.
While Environmental regulators were early adopters, civil sanctions can now be issued by regulators covering topics as broad as product compliance, eco design and non-automatic weighing equipment. Plus based on their 'reasonable belief' when the upcoming Digital Markets, Competition and Consumers Act becomes live will have the power to issue fines of up to 10% of turnover and these powers will also be central to the upcoming product safety review.
